Terms of Service & Clinical Disclaimer
Version: 2026-11-07
VergeOptics ("the software", "we") is clinician-guided visual training software. By creating an account or using the software you agree to these terms. Please read them: they explain what the software is, what it is not, and what you are responsible for.
1. What the software is, and is not
- The software presents visual exercises (random-dot stereograms and moving targets viewed through red/blue glasses) that are used in orthoptic and vision-therapy practice, and it records how you perform.
- It is to be used only as prescribed and supervised by a licensed eye-care professional (an optometrist, ophthalmologist or orthoptist — "your clinician"). Your clinician decides whether the exercises are suitable for you, which ones to do, for how long and at what level.
- The software does not diagnose any condition. A score, a demand level or a chart in the software is a record of what you did in the exercise, not a medical finding.
- The software does not replace emergency eye care, a comprehensive eye examination, or the judgement of your treating clinician.
- The software is not a certified medical device unless we expressly state so for your jurisdiction. Regulatory status: the software is not registered or certified as a medical device in any country at this time. It is offered as clinician-guided visual training software for use under the supervision of an eye-care professional; where a country requires registration for such software to be supplied there, we will not supply it in that country until the registration is in place.
2. When to stop and seek care
Stop using the software and contact your clinician, or seek emergency care, if you experience any of the following during or after an exercise:
- new or persistent double vision;
- eye pain, headache or nausea that does not settle within a few minutes of stopping;
- flashes of light, new floaters, a shadow or curtain in your vision, or any loss of vision;
- dizziness, disorientation or any symptom that worries you.
Mild tiredness of the eyes after a session is common; worsening symptoms are not, and are a reason to stop.
3. Calibration, glasses and the prescribed plan
- The exercises depend on correct viewing distance and screen calibration: the software converts prism dioptres and millimetres into pixels using the screen width, viewing distance and interpupillary distance you enter. You are responsible for calibrating as instructed, re-checking it when you change device or seating, and sitting at the distance the software states.
- You must wear the red/blue glasses the right way round and any spectacles or prism your clinician has told you to wear for the exercises.
- We accept no liability for use with unapproved or incorrect calibration, with the wrong glasses or prescription, at the wrong distance, or outside the plan your clinician prescribed (exercises, durations, levels or frequency).
4. Health warnings
- Photosensitivity. The exercises show high-contrast patterns that move, jump and alternate. A small number of people may experience seizures or other symptoms when exposed to such patterns, even with no prior history. If you have epilepsy, a history of seizures or photosensitivity, tell your clinician before starting and do not use the software without their approval.
- General health. Do not use the software if you are unwell, very tired, under the influence of alcohol or sedating medication, or have had a recent eye operation, eye injury or concussion, unless your clinician has cleared you.
- Do not use the software while driving, operating machinery or in any situation that requires your full attention. The exercises disturb normal binocular vision for a short time; allow a few minutes after a session before such activities.
- Minors may use the software only with a parent or guardian present and under the supervision of their clinician. The guardian accepts these terms on the minor's behalf.
- Take breaks. Do not exceed the daily plan without your clinician's agreement.
5. Accounts, roles and approval
- You must sign in with a valid e-mail address or a supported account provider. Keep your access secure; do not share it.
- Patient accounts are reviewed before they can train. Approval may be given by an administrator or by the therapist who invited you or to whom you are linked. We may refuse, suspend or close an account at our discretion, for example when the intake answers indicate the software is not suitable for you.
- Therapist accounts are for licensed eye-care professionals. We may verify the details you give and may refuse or withdraw access.
6. Your data
- What is stored. Your account details (name, e-mail, provider identity), your acceptance of these terms, your role and approval status, your intake answers (medical history and symptom ratings), your device calibration(s), your training programme, and every recorded session: each trial's demand, target, answer, response time and events (breaks, recoveries, pauses) with a summary.
- Who can see it. You; the therapist you are linked to; administrators of the service. Nobody else. Administrators act only to operate the service (approvals, support, security).
- Export and deletion. You can export your data from the app at any time. You can ask for your account and data to be deleted; we will do so within a reasonable time, except where we are required to retain records by law.
- No sale of data. We do not sell personal data and do not share it with third parties for their own purposes.
- Analytics cookies. When enabled, the service uses Google Analytics 4 to count page views and understand which parts of the app are used. No medical data, no intake answers and no session results are sent to analytics; the exercise stimulus itself is never tracked.
- The Privacy Notice explains this in detail.
7. Acceptable use
Do not use the software for anyone other than the person whose account it is; do not attempt to access other users' data; do not use it where it is unlawful to do so. In particular you must not:
- copy, download, scrape, record or otherwise extract the software, its stimuli, exercises, texts, images, documentation or data, except the export of your own data the app provides;
- reverse-engineer, decompile, disassemble or otherwise try to derive the source code, the calibration, staircase or scoring logic, or the design of the stimuli;
- resell, sublicense, rent, lend or make the software available to anyone else, or offer it as part of another product or service;
- remove or alter any copyright, trademark or other proprietary notice;
- use automated tools, bots or scripts against the service, overload it, probe it for vulnerabilities, or interfere with its operation or other users;
- use the software, or anything learned from it, to build a competing product.
We may suspend or close an account that breaks these rules, and we reserve all other remedies.
8. Intellectual property and your licence to use the software
The software — its code, exercises, stimuli, calibration and scoring methods, texts, images, documentation, trademarks and logos — is owned by the provider of the service and protected by copyright, trademark and other intellectual-property laws. "VergeOptics" and the VergeOptics logo are trademarks of the provider; nothing here grants you a right to use them.
You receive a personal, non-exclusive, non-transferable, revocable licence to use the software through your own account, as prescribed by your eye-care professional, for the duration of your subscription or approval. Nothing is sold to you: no title or ownership passes, and all rights not expressly granted are reserved. Your own training data remains yours; you grant us the right to store and process it to run the service, as the Privacy Notice describes.
Payments and refunds. A patient subscription is bought through PayPal (which also takes cards) for a fixed number of recorded sessions, shown on the payment page; PayPal holds the receipt. You may ask for a full refund within 14 days of the purchase if fewer than 5 sessions were recorded on the account; write to the contact address in section 11.
9. Availability and changes
The software is provided as is and as available. We may change, suspend or stop it, and we may change these terms; when the terms change materially you will be asked to accept the new version before continuing. The version you accepted, and when, is recorded on your account.
10. Limitation of liability and jurisdiction
To the fullest extent permitted by the law that applies to you, the provider of the service is not liable for any indirect, incidental, special or consequential loss, or for loss of data, income or opportunity, arising from the use of or inability to use the software, and the provider's total liability for any claim is limited to the amount you paid for the software in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or your statutory rights as a consumer. You agree to indemnify the provider against claims arising from your use of the software in breach of these terms.
These terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Any dispute that cannot be settled by discussion is subject to the exclusive jurisdiction of the competent courts of Tel Aviv–Jaffa, Israel, except where the consumer-protection law of your country of residence gives you the right to bring a claim at home. The service is provided by the operator of VergeOptics, Israel; the contact details are in section 11.
